Delhi HC directs police action against Karol Bagh vendors selling suspected counterfeit branded goods

The Delhi High Court has directed the Delhi Police to take legal action against street vendors in Karol Bagh found selling suspected counterfeit products bearing names of prominent brands, including Louis Vuitton, H&M, Zara, Allen Solly, Puma and Calvin Klein.

A division bench of Justice Prathiba M. Singh and Justice Vikas Mahajan issued the direction while hearing a petition filed by 24 street vendors holding provisional Certificates of Vending (CoVs), who had approached the court seeking protection against alleged harassment by the Municipal Corporation of Delhi (MCD).

During the proceedings, the MCD submitted photographs showing that several petitioners were operating in the notified no-vending and no-hawking stretch of Ajmal Khan Road. The images also showed merchandise carrying names and logos of well-known brands.

Taking note of the material placed before it, the court observed that if the products being sold were counterfeit or passed-off goods, such activity would amount to illegal conduct under the conditions attached to vending certificates.

“If the products sold by the petitioners are counterfeit products or passed-off products, the same would constitute an illegal and unlawful activity,” the bench observed, while noting that the issue was not directly before the court but could not be ignored.

The court directed the Station House Officer (SHO) of Karol Bagh Police Station to take action against the petitioners and other vendors found involved in selling counterfeit branded goods and proceed in accordance with law.

The bench also made it clear that no vendor would be allowed to operate on the stretch of Ajmal Khan Road between Karol Bagh Police Station and Karol Bagh Metro Station, which has been declared a no-vending and no-squatting zone.

The MCD informed the court that all 24 petitioners had been issued provisional CoVs only as mobile vendors and had not been allotted permanent tehbazari sites. It said mobile vendors were required to remain mobile and operate only in permitted areas as per the conditions of their certificates.

After examining the photographs and status report, the court noted that several petitioners were functioning as stationary vendors despite holding certificates meant for mobile vending.

The court directed that vendors must strictly follow the conditions of their CoVs and refrain from operating in any notified no-vending or no-hawking area. If violations are found, the MCD and police authorities must remove such vendors to ensure pedestrian movement and easy access to Karol Bagh Metro Station.

The bench also highlighted concerns regarding the lack of awareness among vendors about restricted zones due to inadequate signage. It observed that several no-vending areas could remain only on paper unless properly marked on the ground.

The court directed Town Vending Committee-II, after its constitution, to ensure installation of signboards identifying no-vending and no-squatting zones.

The MCD informed the court that signboards had already been installed on Ajmal Khan Road indicating that the area was a prohibited vending zone.

The petitioners were allowed to continue their mobile vending activities outside restricted areas, subject to compliance with their vending certificates and the additional directions issued by the court.
